Family law is the general classification assigned to the multiple areas of legal practice that cover domestic relations. This includes a wide variety of topics and issues, from marriage and divorce to adoption and surrogacy. Below are the main points of emphasis in family law.

Entering into marriage – A marriage is not only a sacred vow made between man and wife before God; it is also a legally binding contract. It states that two people are agreeing to share every part of their lives together, including finances, debts, properties, and parenting responsibilities. Some couples make the decision to sign a prenuptial agreement, which preemptively determines how assets will be divided in the event the marriage does not last.

Dissolution of marriage – As unpleasant as it is, the fact remains that nearly 50% of all marriages in the United States end in divorce. Therefore there exists an entire set of laws governing the ensuring complications, such as alimony, division of property and assets, child custody and child support. There are two main ways to dissolve a marriage: annulment and divorce. An annulment retroactively declares a marriage null and void, as though it never took place. The prerequisites to qualify for an annulment, such as insanity and fraud, vary from to state to state. A divorce is the final termination of a marriage contract, which cancels the legal obligations and bond of matrimony between two people.

Child Issues – Understandably, either the beginning or the end of a marriage can greatly affect the lives of any children involved. Issues include, but are not limited to, custody, support, paternity, adoption, abuse, abduction and foster care.

There is also another subdivision of family law devoted to the concerns of unmarried couples, such as common law marriages and same sex partnerships. These laws also vary greatly from state to state. From Florida to California, Miami to Stockton, lawyer firms specializing in family law can help you navigate these turbulent and confusing waters.

Tampa divorce attorneys at the law offices of Carey & Millison, P.A is distinguished in the practice of Marital, Family and Civil Law as well as Family and Civil Mediation. Their Tampa Bay law firm represents clients and their families throughout Florida, including Hillsborough, Pinellas, Pasco, Polk, Hernando, Manatee and Sarasota Counties. Their attorneys provide a full scope of legal services in all aspects of Family Law – paternity, divorce, alimony, child support, child custody, visitation and domestic violence actions as well as premarital and post-marital agreements.

Utilizing more than 60 years of combined experience and specialized knowledge in marital and family law, their attorneys are highly skilled in helping you effectively accomplish what is best for you and your family. If you are facing a divorce, or need compassionate mediation services or require trusted legal advice concerning other marital, family law or civil matters, you may call their law firm to arrange an appointment with one of their attorneys.

There are some effective tactics that you may want to think about at the time that you look for an Oregon divorce attorney. When you begin this process, you had better consider the sort of case that you will be pursuing. Will you be mediating your divorce suit? Will you be negotiating? Or, could your lawsuit be the kind of lawsuits that lands in family or divorce court and turns into a knock down, drag out litigation?

You need to locate an Oregon divorce attorney who limits his/her practice to these types of matters and you need to retain the type of Oregon divorce attorney who is best suited to the sort of case that you are involved with. If you wish to pursue knock-down-and-drag-out litigation, you should not retain a mediation attorney to enforce your rights. On the other hand, if you are undergoing a mediation process, it would be unfortunate if you hired an Oregon divorce attorney who will attempt to create problems and persuade you to start litigation.

Therefore, step one in the process of hiring an Oregon divorce attorney is to ascertain the type of case that you have. After you finish that, find other people who have gone through what you are going through. Since the rate at which we divorce in the U.S.A. is around one-half , chances are you know several other people who have undergone a divorce suit. Ask them about their case, how they employed an Oregon divorce attorney, and how their attorney worked out for them.

After you have received feedback on a couple Oregon divorce attorneys that you found from checking with others, go on the internet and start exploring those attorneys and any others that you find on the net. If an Oregon divorce attorney has an internet site, you can review it and also look to determine if they have composed any articles on divorce law. You can likewise check and determine if they have advertised their website on the net on the issue of divorce law. You can get quite a bit of important information regarding any particular attorney, their cases and the way they treat their clients by reviewing their internet site.

Subsequent to your analyzing the Oregon divorce attorney websites, compile a listings of at the least a half of dozen Oregon divorce attorneys who you suppose you could be comfortable meeting with. Telephone each of the divorce attorneys and schedule an initial meeting. A number of those attorneys bill a fee for for an initial meeting; the more experience the attorney has, the more likely that you may be billed for time with that attorney.

When you attend an initial interview/evaluation with an Oregon divorce attorney, be organized. Spend the time to write a history of your married life and the issues confronting you right now. Take one to three years tax returns or a current financial statement so that the attorney can go over some of your financial accounting before being questioned concerning

Throughout Florida, there are excellent attorneys who specialize in the dissolution of marriage and they can help individuals know how to begin the proceedings. An attorney will understand which paperwork is necessary to begin the process. They also know when and where the forms and documents are to be submitted. They can also help explain any legal terms or phrases which may be difficult for someone to understand, as they sort through and complete the lengthy forms. Basically, an attorney should be available to walk their client through the process.

Additionally, attorneys are essential when it comes to offering representation during mediation. Good representation is often the key to a smooth mediation process. An attorney can also be useful in pre-mediation discussion, helping separating couples achieve a harmonious solution. They can be the objective third-party, offering suggestions for peaceful solution. They can also be the clear-headed voice of reason when tempers flare. Attorneys may be able to present ideas or arrangements which they have seen work successfully during past cases. They can bring a valued perspective to the negotiation table.

Attorneys can also work closely with other professionals who may be involved in separation proceedings. Perhaps that may be marriage counselors, who have offered their services in attempt to reconcile the couple. Perhaps it may be children’s services or law enforcement officials, if one of the separating parties has committed acts which are of danger to anyone in the family. A good attorney will collect input from all involved sources and be able to present that information to a judge if it is found to be necessary.

The bottom line is that Florida residents will experience some of the same joys and hardships facing all Americans throughout the other forty-nine states. For the couple who is separating, there are many things to consider as they go about the separation process. The individual who consults and follows the advice of an attorney who specializes in the dissolution of marriages will be better able to take control of the future.

Not every individual in a marriage that is experiencing trouble should begin looking for a family law attorney. Many people who eventually decide to dissolve their marriage believe that they will be able to do so without unnecessarily involving legal professionals, unknowingly exposing both parties to potential frustrations and dissatisfaction. Divorce attorneys in Houston are usually helpful no matter how amicably the marriage ends, and they are particularly advantageous when parties consider the following:

Division of Property and Assets

An attorney is able to draw up legal documents that will fairly and clearly divide up the property and assets that were purchased or earned during the marriage. Regardless if you and your former spouse believe you can divide these assets without legal assistance, you need to protect everyone involved by creating documents recognized by the Court.

Establishing Custody Rights and Visitation

If you have children, it is imperative that both parties establish who will have primary custody of the kids. While it may be easy to assume that both parents will want to do what is best for their children, sometimes it is hard to agree on what exactly is “the best thing”. Your family law attorney will work with both parties to make sure that everyone’s legal rights are met and that parents get the visitation time they deserve-even if they are not the primary custodial parent.

Legal establishment of child support and any alimony/palimony

Whether or not both individuals have professions that allow them to earn a living after the divorce, attorneys in Houston will likely look into the legal aspects of alimony or palimony. This often occurs when one spouse has sacrificed personally or professionally in order for the other partner to further his or her own career, reducing the ability for the recipient to earn an income that is as high as it would have been otherwise. Not every divorce will require this type of payment, but divorcing spouses should not assume that they are not eligible for this reimbursement without speaking with an attorney.

As a general practice Houston law firm, Sondra Kaighen & Associates, P.C. serves clients with diverse needs throughout Houston and the Texas Gulf Coast area. Their attorneys cover a range of legal issues pertaining to family law and criminal law. Sondra Kaighen, the firm’s principle, has over twenty years of experience in family law and is a certified specialist in the field by the Texas Board of Legal Specialization.

The lawyers at Sondra Kaighen & Associates, P.C., are very dedicated and active legal professionals. For them, helping people with legal needs is not a ‘9 to 5’ job. They attend seminars and industry events to stay abreast of the ever-changing laws affecting their practice and participate in lectures and various legal associations. If you have a legal question or concern, do not hesitate to contact their Houston law firm.

Divorce is expensive and time consuming. Couples facing divorce will have to deal with airing out their dirty laundry, dealing with the emotional pain and paying cost of courts, lawyer fees and dividing their assets with their spouse. With mediation, much of the unnecessary drama of getting a divorce can be reduced if not completely avoided.

What happens during mediation?

The divorce mediator will explain how the law system works to the couple and if the mediator is an attorney can draw up and file court papers. Unlike arbitration, mediation is not a legally binding decision made by your mediator. Instead, couples have complete control over what decisions are made and can walk away from mediation at any time. Some states, however, use court-ordered divorce mediation for couples with children to help negotiate child custody and visitation issues.

How to Pick A Divorce Mediator?

Mediators should have received training from a recognized source and should be able to provide references from attorneys, fellow mediators and other recognized professionals. A mediator with several years of experience has more knowledge than a beginner; some mediators are also family lawyers themselves. The cost will also help when choosing a mediator, most charge a fee for each session lasting around one to two hours.

How Will Common Assets Be Divided?

A divorce mediator can draw up a settlement agreement for couples showing how property and finances will be divided once a settlement is reached. To do this the mediator will aid each party in determining what they own, as well as determine what they owe out in the form of taxes and other debts. Financial planning tools such as budgeting may be used to help understand how the divorce will affect finances. Divorce mediation might also review how the judge is likely to divide assets based on how much income and property each spouse bought to the marriage. Issues of alimony, child custody, how parenting duties will be shared and child support may also be determined.

Is A Lawyer Still Needed?

Mediation is not a substitute for seeking the advice of legal counsel. Mediators should not discourage hiring or consulting with an attorney during a divorce. In fact, many encourage their clients to bring their attorneys with them to divorce mediation. A lawyer will help prepare for negotiating with the spouse and ensure the agreement or settlement reached is in their best interest.

Divorce mediator in San Francisco at law firm McDonald & Mannion provides individuals and families with resolution through mediation in cases of divorce, personal injury matters, and probate and business disputes.

Family law firms deal with much more than just divorce cases. While much of the practice does tend to deal more with marriage concerns, attorneys involved in such practices involve themselves with all types of issues related to the relatives, including maternity, wills, estates, paternity, and trusts. These lawyers may work for firms both big and small.

Step 1: In order to enter law school, one must obtain a bachelor’s degree. Once this has been addressed, many students begin an internship somewhere around their second year.

Step 2: While in school, take courses in family regulation, mediation, estates and trusts, wills, trial advocacy, counseling, pretrial advocacy, and interviewing.

Step 3: Register yourself for the Section of Family Law and the Student Division of the American Bar Association. Subscribe and study Family Law Quarterly as well as Family Advocate to keep yourself up to date to new developments and procedures.

Step 4: Write independent research papers and articles pertaining to various topics surrounding the field. Articles may be submitted to the school’s journal as well as other journals who are currently accepting submissions.

Step 5: Begin participation in the Moot Court Competitions. In this way you will be able to better prepare for trials and also be able to gain a better understanding of what the court process entails. In addition, enter the ABA’s Client counseling or Negotiation competitions whenever the current issue relates to your line of study. The skills gained from such an experience are all necessary to becoming a successful lawyer.

Step 6: Attend networking events held by local regulation practices to cultivate relationships and network with professionals within the community.

Step 7: Build your resume, outlining your skills, accomplishments, and experience. Draft a cover letter as well.

Step 8: Complete law school. Apply for positions at practices or for clerkships alongside judges.

Step 9: Once the school is through, pass the state bar exam in order to become licensed. Begin practicing it.

Step 10: Attend continued legal educational courses and seminars pertaining to the same.

Step 11: Gain membership within local bar associations working groups and attend workshops.

At this point, you should have all the tools you need to be a success. All it takes is a bit of discipline, hard work, and a whole lot of drive.

Finding the right family law attorney (or divorce lawyer) is a process that many people are not entirely comfortable with. People often don’t know what qualifications to look for. Often the only information people have to go on is a recommendation from a friend, or listings in a phone book. But retaining legal representation for your divorce is a process that warrants some extra due diligence on your part. Here are some tips to help you find the best divorce attorney for you:

Create a list: You could open the phone book to ‘divorce lawyers’ and just point to see which you see first. But there is a better way. If you feel comfortable asking friends to recommend a divorce lawyer that may be a good place to start. You can also check one of several reputable family law yellow pages on the internet. Those directories will help you find qualified divorce lawyers in your area. Make sure you only consider family law attorneys who practice in the county where you live. The details of family law can vary significantly from one county to another.

Narrow the list: Look for lawyers who have devoted their entire practice to the area of family law. Several states offer certifications in family law legal specialization. Ensure that the divorce attorneys on your list are in good standing with your state bar. Also, while there is no single label that universally identifies good divorce lawyers, a generally respected lebel is the Martindale Hubbell peer review rating. Attorneys only qualify for this rating after they have been admitted to the bar for five years or more.

Meet face-to-face: Be aware of the responsiveness of each firm or attorney to your meeting request. You want to be sure that the family law attorney you retain is able to devote an adequate amount of time to your case; if it takes 3 business days or more to get a call back it may be an indication that they are too busy to give your case the attention it deserves. When you do meet with your short-list candidates, ask about their experience with cases like yours. Realize that the attorney you interview may not be the one who is actually assigned to your case. Ask which associate will be working on your case, and meet that individual as well. He or she will likely be your day-to-day point of contact and it is important that you feel comfortable working with him/her.

If it’s worth hiring a divorce lawyer for your case, it’s worth this extra homework up front. Take the time to create a qualified list of candidates and have a better chance of finding the best divorce attorney for you.
